Terms of Service

1. Acceptance of Terms

By accessing or using Lumaras, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you have the right, authority, and capacity to enter into these Terms. If you are using Lumaras on behalf of a company or organization, you represent that you have the authority to bind them to these Terms.

2. Your Account

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate and truthful information when creating your account and choosing your display name.
• You may not impersonate another person or entity, and you may not use a display name that is already taken by another user.
• Lumaras reserves the right to suspend or terminate accounts that violate these Terms or applicable law.

3. Virtual Currency (Coins and Gems)

• Coins are the in-app viewer currency purchased with real money. They are used to send gifts to creators during live streams.
• Gems are the in-app creator currency earned from gifts received. Gems are converted to USD when creators request a cash-out.
• All coin purchases are final. Refunds may be granted at Lumaras's discretion in cases of technical failure or unauthorized use.
• Coins and gems have no monetary value outside the Service and are not transferable between users or exchangeable for cash, except through the official cash-out process for creators.
• Lumaras may adjust coin-to-gem conversion rates and payout thresholds at its discretion.

4. Creator Earnings and Cash-Outs

• Creators earn gems when viewers send gifts during their live streams.
• Creators may request a cash-out once they reach the minimum gem threshold specified in the app.
• Cash-out requests are processed in the order received and are subject to review for fraud and compliance.
• Lumaras retains a percentage of gift revenue as a platform fee. The current rate is displayed in Creator Studio.
• Lumaras is not responsible for incorrect payout details provided by the creator.

5. Acceptable Use and Content Guidelines

• You agree not to broadcast, upload, post, or transmit content that is illegal, abusive, fraudulent, misleading, or infringes on someone else's intellectual property.
• You agree not to harass, defame, or impersonate other users.
• You agree not to use automated systems, bots, or scripts to interact with the Service.
• You agree not to attempt to reverse-engineer, decompile, or otherwise discover the source code or underlying technology of the Service.
• Streamers are responsible for their own broadcast content and must comply with all applicable laws, including music and music-licensing laws.

6. VS Battles

VS Battles are an optional feature where two creators compete for gift support during a timed match. Participation in VS Battles is voluntary. The outcome (winner determination) is based solely on gift volume and is automated. Lumaras is not responsible for disputes arising from VS Battle outcomes.

7. Prohibited Activities

• Using the Service for unsolicited commercial messages or spam.
• Attempting to manipulate the virtual currency system, coin balances, or gem balances.
• Sharing payment credentials or using another user's payment method without authorization.
• Using the Service to promote illegal goods or services.

8. Intellectual Property

All content, trademarks, logos, and software provided as part of Lumaras (excluding user-generated content) are owned by Lumaras or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without express written permission.

By broadcasting or posting content on Lumaras, you grant Lumaras a worldwide, royalty-free, sublicensable license to use, reproduce, and display that content within the Service for the purpose of operating and improving the Service.

9. Third-Party Services

Lumaras integrates with third-party services for payment processing (Base44 Payments / Wix Payments) and live video infrastructure (LiveKit). Your use of these services is subject to their respective terms and privacy policies. Lumaras is not responsible for the practices of third-party providers.

10. Limitation of Liability

Lumaras and its affiliates are provided "as is" without any warranty. To the maximum extent permitted by law, Lumaras shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of or inability to use the Service, including but not limited to loss of virtual currency, loss of earnings, or loss of data.

11. Account Termination

You may delete your account at any time from within the app settings. Upon deletion, your profile, streams, chat messages, and associated data will be permanently removed. Lumaras may terminate or suspend your account at its discretion, with or without notice, if you violate these Terms or if your account remains inactive for an extended period.

12. Changes to These Terms

Lumaras may modify these Terms at any time. We will notify you of significant changes by posting the updated Terms within the app or by other means. Your continued use of Lumaras after any changes constitutes acceptance of the revised Terms.
